Agreement
These Terms & Conditions (the “Terms”) govern your access to and use of the website www.sarkyjewelry.com and the purchase of products through the Website, as operated by SARKY JEWELRY (“SARKY JEWELRY”, “we”, “us”, “our”). By using or accessing the Website — including browsing, placing an order, creating an account, or using any services — you (“you”, “the customer”, “user”) agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Website or place an order.

We may revise or update these Terms at any time. Changes take effect immediately upon posting on the Website — your continued use after any modification constitutes acceptance of the new Terms. You should revisit these Terms regularly. If you do not accept any change, you must cease using the Website immediately.

• To use certain features (e.g. placing an order, booking a service) you may need to register and provide accurate, current, and complete information about yourself.
• You agree to maintain and promptly update any account information when it changes.
• You are responsible for maintaining the confidentiality of your account password and for all activities under your account. If you suspect any unauthorized use, notify us immediately.
• We are not liable for any loss or damage arising from your failure to keep your account secure.

You confirm that you are legally capable of entering into a binding contract under the laws of the United Arab Emirates and, where relevant, that you are at least 18 years old (or have reached the legal age required to purchase jewellery).

When placing an order, you warrant that all information provided (name, contact details, billing details, payment method) is true, accurate, current, and belongs to you.

• We list products available for sale on the Website.
• Occasionally stock may be unavailable or quality issues may arise.
• If a product you ordered becomes unavailable, we will notify you by email and issue a full refund within 30 days.
• Display of a product on the Website does not guarantee its availability.
• In case of an error in availability or pricing, we reserve the right to cancel your order, inform you, and refund amounts paid.
• Prices displayed are in AED and exclude any taxes or duties, unless otherwise stated. We reserve the right to change prices at any time before dispatch.
• Upon placing an order, you will receive an order confirmation email. This does not constitute contract acceptance. The sale contract is formed when we dispatch the products and you receive a dispatch confirmation (with tracking).
• You agree that a third-party payment processor or courier cannot accept orders on our behalf or finalize the contract. We reserve the right to refuse or cancel any order at any time, for any reason, including lack of payment authorization, regulatory or shipping restrictions, or failure to meet eligibility criteria.

• Payments are accepted via the methods clearly displayed on the Website (e.g. Visa, MasterCard, or other payment solutions).
• By using a payment method, you confirm that the payment card or method belongs to you and is valid. All payments are subject to authorization by the card issuer or payment provider.
• Payment processing is handled securely by third-party payment gateways, and we do not store full payment card details on our servers.
• If payment authorization fails or is declined, we will not be responsible for order processing or delivery delays.

• We ship orders within the United Arab Emirates. Shipping is free (unless stated otherwise), and delivery times indicated are estimates based on dispatch date.
• We aim to deliver within 30 days of dispatch.
• However, delivery times are not guaranteed, and delays due to factors beyond our control (e.g. courier delays, customs, force majeure) may occur.
• In such events, we will inform you as soon as possible and take steps to minimize delay.
• Every order is insured during transit until delivery to your address. A signature (or proof of receipt) is required on delivery. Once delivered and signed for, the responsibility for the products passes to you (or the recipient if the order is gifted).

Our policy regarding returns or exchanges (if applicable) will be posted separately or detailed on the Website. Returns or exchanges — when permitted — require original invoice and must comply with the conditions specified on the Website or in-store.

• All content on the Website — including text, graphics, images, designs, logos, product photos, trade names, button icons, and layouts (collectively “Website Content”) — is owned or licensed by SARKY JEWELRY.
• You may use the Website for personal, non-commercial purposes only. You may not copy, reproduce, modify, publish, distribute, transmit, frame, create derivative works from, or otherwise exploit any Website Content without our prior written permission.
• You may not attempt to access restricted parts of the Website, attempt to breach security, reverse engineer the Website’s software, or use any automated tools to scrape or harvest data.
• Unauthorized use of Website Content or Marks may lead to legal action under applicable intellectual property laws.

• The Website may contain links to third-party websites (“External Sites”) for convenience.
• We are not responsible for their content, privacy practices, or availability.
• Visiting external links is at your own risk.
• Occasionally, we may run promotions, discounts, coupon codes, or gift-with-purchase offers. Such promotions are subject to additional terms (available during the promotion) and may be modified or withdrawn at any time without notice.
• Promo codes and discounts are valid only if explicitly stated; fraudulent or unauthorized use may lead to cancellation of orders or refusal of discounts.

• The Website and all content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law.
• SARKY JEWELRY and its associated companies are not liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Website, purchase or inability to purchase products, or reliance on content.
• This includes lost profits, loss of data, business interruption, or other intangible losses.
• We are not responsible for failures caused by factors beyond our control — such as acts of God, war, fire, flood, shortages, power failures, strikes, government actions, or other force majeure events.

You agree to indemnify and hold harmless SARKY JEWELRY (and its affiliates, directors, employees, agents) from any claims, damages, losses or expenses (including legal costs) arising from your breach of these Terms, your use of the Website, or your violation of applicable law or rights of a third party.

If any provision of these Terms is found by a court or competent authority to be invalid or unenforceable under applicable law, such provision shall be deleted or limited to the minimum extent required, and the remaining provisions will continue in full force and effect. Failure or delay by SARKY JEWELRY to enforce any right or provision under these Terms does not constitute waiver of that right or provision.

These Terms constitute the entire agreement between you and SARKY JEWELRY regarding use of the Website and supersede all prior agreements or understandings.

These Terms and your use of the Website are governed by the laws of the United Arab Emirates as applied in the Emirate of Abu Dhabi. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Abu Dhabi, United Arab Emirates.
